These terms govern your use of this website and anything you buy from it. By placing an order you accept them.
[TO COMPLETE BEFORE LAUNCH] Replace the bracketed placeholders and have a solicitor review this document. It is a working draft, not legal advice.
1. Who we are
Brightleaf sells downloadable digital guides.
- Legal entity: [TO COMPLETE: registered company name, or "sole trader"]
- Registered address: [TO COMPLETE: address]
- Company number: [TO COMPLETE, if a limited company]
- VAT number: [TO COMPLETE, if VAT registered]
- Contact: hello@damidigitallibrary.com
2. What you are buying
You are buying a licence to read and use a digital guide. You are not buying the copyright in it.
3. Your licence
When you buy a guide, we grant you a personal, non-exclusive, non-transferable licence to:
- Download and keep your own copy
- Read it on any device you personally own
- Print a copy for your own use
You may not:
- Resell, rent, sub-licence or otherwise distribute it
- Share it publicly, upload it to a file-sharing service, or post it online
- Remove or alter the watermark or copyright notices
- Use it to train a machine learning model or dataset
- Reproduce substantial parts of it in your own commercial material
This licence lasts indefinitely, but we may end it if you breach these terms.
4. Watermarking
Every file we deliver is watermarked with the email address and order reference used to buy it. This is stated here so it is never a surprise. It is not copy protection and it will not stop your file working anywhere. It exists so that if a copy is posted publicly, we can see where it came from.
5. Price and payment
- Prices are shown in pounds sterling and include any applicable tax unless stated otherwise.
- Payment is taken by Stripe. We never receive or store your full card details.
- [TO COMPLETE: VAT position. If you sell to consumers in the EU, VAT is due in the customer's country from your very first sale, with no threshold. Either register for the VAT One Stop Shop, enable Stripe Tax, or restrict sales to the UK. Take advice on this before you run adverts in the EU.]
- We may change prices at any time, but never for an order already placed.
6. Delivery
Your download is available immediately after your payment is confirmed, on the confirmation page and by email. Download links are personal to you and are tied to your order.
If your download does not arrive, email hello@damidigitallibrary.com and we will send it to you directly.
7. Cancellation and refunds
Because your guide is delivered immediately, you consent at checkout to immediate supply and give up the 14-day cancellation right that would otherwise apply. Your statutory rights where a file is faulty or not as described are unaffected.
The full position is set out in our Refund Policy, which forms part of these terms.
8. What our guides are, and are not
Our guides are general information, written to be practical and honest. They are not professional advice.
In particular:
- Guides covering money, business or tax are not financial, investment, legal or tax advice. Speak to a qualified professional about your own circumstances.
- Guides covering health, wellness or stress are not medical advice and are no substitute for a doctor or therapist. If you are unwell, seek proper care.
- Guides covering careers describe general approaches, and cannot guarantee a job, a promotion or a pay rise.
We do not promise any particular result. What you get out of a guide depends on your own situation and what you do with it.
9. Availability
We try to keep the website available at all times, but we do not guarantee it. We may change, withdraw or update guides, and may take the site down for maintenance.
10. Our liability
Nothing in these terms limits our liability for death or personal injury caused by negligence, for fraud, or for anything else that cannot lawfully be limited — including your statutory rights as a consumer under the Consumer Rights Act 2015.
Subject to that, we are not liable for business losses, loss of profit, or indirect or consequential losses, and our total liability for any order is limited to the amount you paid for it.
11. Your account and conduct
You agree not to attempt to gain unauthorised access to the website, to interfere with its operation, to probe or test its security, or to use automated tools to download files you have not paid for.
12. Intellectual property
All content on this website and in our guides — text, design, covers and branding — belongs to us or our licensors and is protected by copyright.
13. Changes to these terms
We may update these terms. The version that applies to your order is the one published when you placed it.
14. Governing law
These terms are governed by the law of England and Wales, and disputes fall to the courts of England and Wales. If you live elsewhere in the UK or in the EU, you keep the benefit of any mandatory consumer protections of your home country.
15. Complaints
Email hello@damidigitallibrary.com. We aim to reply within one working day and to resolve things without fuss.
